Dear Members,
Please find attached herewith the COWAS Byelaws, 2020. It will be circulated on website as well. If you have any suggestions, please do write to the undersigned.I would request all members to make their suggestions brief and precise. You will all kindly appreciate that the legal aspect of the Byelaws are not open to debate. Some provisions are there by legal necessity and which are strictly in accordance with the Societies Registration Act & the Rules & Regulations. You may like to restrict your suggestions to the kind of machinery that have been devised to control, monitor and supervise the financial functioning of the MC. We have devised and created an overarching and mentoring role of the Finance Committee in so far as the financial functioning of the Association. This I thought it is paramount, since in my experience as a practising lawyer most of the complaints against MC relate to financial bungling. Hence a device to oversee and act as the permanent watchdog (5 years fixed tenure). Secondly, the power of the FC to recommend removal of the MC to the GB, call for emergency meeting of the GB and such like matters. Another important novelty feature of the Byelaws is the provision for disputes resolution between members and MC, mostly pertaining to arrears and dues, through the mode of inhouse mediation and Arbitration. We can avoid the cumbersome and prolix court proceedings and substitute it with our own effect and expeditious method, which have the sanction of law.
